Terms of Service

These Terms govern your use of PebbleCare. By creating an account or using the service you agree to these Terms and our Privacy Policy.

1. The service

PebbleCare is a software platform that helps home daycare providers manage their business and helps families find and coordinate with providers. PebbleCare is not a daycare, does not provide childcare, and does not employ providers. All care arrangements are between families and providers directly.

2. Eligibility

You must be at least 18 to create an account. You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity under your account.

3. Provider obligations

• You are solely responsible for compliance with all licensing, zoning, insurance, tax, health, and safety laws applicable to your daycare.
• You must accurately represent your services, capacity, rates, and credentials.
• You are responsible for the children in your care; PebbleCare provides software only.

4. Guardian obligations

• You must accurately disclose information relevant to your child's care (allergies, medical needs, custody, emergency contacts).
• You are responsible for vetting any provider before enrolling.
• Payment terms, schedules, and policies are agreed directly between you and the provider.

5. Acceptable use

You agree not to:

• Misrepresent identity, credentials, or licensing status.
• Harass, threaten, or endanger any user.
• Scrape, reverse engineer, or interfere with the service.
• Use the platform for any unlawful purpose.

6. Content

You retain rights to content you submit (photos, profile copy, messages, logs). You grant PebbleCare a limited, non-exclusive license to host, display, and transmit that content as needed to operate the service for you and the people you authorize.

7. Fees

During the invite-only beta the service is free. We will provide notice in-app and by email before introducing fees, and will not charge you without your explicit agreement.

8. Suspension & termination

We may suspend or terminate accounts that violate these Terms or that pose a safety risk. You may delete your account at any time by emailing support@pebblecare.app.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that any provider listed on PebbleCare is qualified, safe, or suitable for your child. Vetting is your responsibility.

10. Limitation of liability

To the maximum extent permitted by law, PebbleCare and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from care arrangements made between users. Our aggregate liability for direct damages will not exceed the greater of (a) fees you paid us in the 12 months before the claim, or (b) USD 100.

11. Indemnification

You agree to indemnify and hold PebbleCare harmless from claims arising out of your use of the service, your content, or your violation of these Terms — including, for providers, any claim arising from the care you provide.

12. Changes

We may update these Terms. Material changes will be announced in-app or by email. Continued use after changes take effect constitutes acceptance.
